Right of Withdrawal (Widerrufsbelehrung)

Scope and Applicability
This Right of Withdrawal policy applies exclusively to consumers (Verbraucher) as defined in §13 BGB — natural persons who enter into a contract for purposes that are predominantly outside their trade, business, or profession.
This right of withdrawal does NOT apply to:
- Business clients (B2B): Companies, sole traders, partnerships, and other legal entities acting in the course of their commercial or self-employed professional activity (§14 BGB).
- Government and public sector clients (B2G): Public authorities, institutions, and bodies governed by public law.
B2B and B2G clients are governed solely by the applicable General Terms and Conditions (AGB) and the individual contractual agreement. No statutory right of withdrawal exists for these client categories under German law.
Part 1: Right of Withdrawal Information (Widerrufsbelehrung gemäß §§355 ff. BGB)
1.1 Right of Withdrawal (Widerrufsrecht)
You have the right to withdraw from this contract within fourteen (14) days without giving any reason.
The withdrawal period is fourteen days from the day on which the contract is concluded (i.e., the day on which you accept the quotation issued by Tratext GmbH and the contract thereby comes into effect).
To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear declaration (e.g., a letter sent by post, an email, or via the online withdrawal function). You may use the model withdrawal form set out in Part 2 below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. The date of dispatch — not receipt — is determinative.
Online Withdrawal Function (§356a BGB)
Effective June 19, 2026, for contracts concluded via our online platform, Tratext GmbH provides an electronic withdrawal function accessible within the client portal. This function allows you to withdraw from the contract electronically by completing the following steps:
- Navigate to the withdrawal function, permanently accessible and clearly labeled "Withdraw from Contract" (Vertrag widerrufen).
- Provide your contact details, the contract or quotation reference number, and your name.
- Confirm your withdrawal by clicking the confirmation button labeled "Confirm Withdrawal" (Widerruf bestätigen).
Your withdrawal becomes effective upon clicking the confirmation button, irrespective of whether Tratext GmbH has acknowledged receipt. You will receive an electronic confirmation of your withdrawal on a durable medium without delay.
1.2 Effects of Withdrawal (Widerrufsfolgen)
If you withdraw from this contract, Tratext GmbH shall reimburse all payments received from you, without undue delay and in any event no later than fourteen (14) days from the day on which we are informed of your decision to withdraw.
The refund shall be made using the same means of payment that you used for the initial transaction, unless expressly agreed otherwise. In no event will you be charged any fees as a result of such reimbursement.
1.3 Early Commencement of Services and Expiry of the Withdrawal Right (§356(4) BGB)
Translation services provided by Tratext GmbH constitute a service contract (Dienstleistungsvertrag). The following special provisions apply:
1.3.1 Consent to Early Commencement
During the quotation acceptance process, you may be asked to give your express consent for Tratext GmbH to begin performing the translation service before the expiry of the 14-day withdrawal period. This consent is voluntary.
If you grant this consent, Tratext GmbH may commence work on your translation immediately upon receipt of payment, rather than waiting until the withdrawal period has elapsed.
1.3.2 Expiry upon Full Performance
Your right of withdrawal expires once the translation service has been fully performed by Tratext GmbH, provided that:
- You gave your express prior consent to the commencement of performance before the withdrawal period expired; and
- You confirmed your knowledge that your right of withdrawal would be lost upon complete performance of the service.
Both conditions must be satisfied for the withdrawal right to be extinguished under §356(4) BGB.
1.3.3 Withdrawal after Partial Performance — Proportional Compensation (Wertersatz)
If you withdraw from the contract after work has begun but before the service has been fully completed, you are obligated to pay proportional compensation (anteiliger Wertersatz) for the services already rendered up to the point of withdrawal.
The proportional amount is calculated on the basis of the total price agreed in the quotation (Angebotsbetrag). If the total price is excessive, the proportional amount shall be calculated on the basis of the market value of the services provided.
This obligation to pay proportional compensation applies only if you were properly informed about this consequence before the commencement of performance.

The following consent text must be presented to consumers during the quotation acceptance flow. The consumer must actively acknowledge each statement (e.g., via individual checkboxes) before the contract is concluded and work begins.

By checking the boxes below, I confirm the following:
☐ I expressly consent to Tratext GmbH beginning the performance of the translation service before the expiry of the 14-day withdrawal period (§356(4) No. 2 BGB).
☐ I acknowledge that my right of withdrawal will expire once the translation service has been fully performed by Tratext GmbH (§356(4) No. 1 BGB).
☐ I understand that if I withdraw from the contract before the translation service has been fully completed, I will be required to pay proportional compensation (Wertersatz) for the services already rendered, calculated on the basis of the total price agreed in the quotation.
Alternative Consolidated Wording
For situations where a single declaration is preferred (e.g., a single confirmation checkbox with the full text displayed):
"I expressly consent to Tratext GmbH beginning the translation service before the expiry of the 14-day withdrawal period. I acknowledge that my right of withdrawal will expire once the service has been fully performed. I understand that if I withdraw before full completion, I will be required to pay proportional compensation for the services already rendered."
